EPCO Limited Lifetime Warranty

Except as set forth under Exceptions below, EPCO Products, Inc. (EPCO) warrants its 304 and 316 Stainless Steel Bow and Stern Eyes and their factory-unaltered hardware components (Products) to be free from rust for five years after the date of original installation and from all other defects in materials and workmanship for the life of the boat upon which they are originally installed.

 

These warranties are available only to the original retail purchaser of such boat. Provided, however, the foregoing warranties are limited by the following Exceptions: EPCO’s obligations under this warranty are limited to the replacement of the defective Products. EPCO will also pay up to $200 for documented removal and reinstallation costs of any Products that are defective under EPCO’s specific rust warranty. In all other instances, labor and other expenses involved in removal, reinstallation or shipment of the defective Products are excluded from this warranty.

This warranty is automatically void and unenforceable if: (a) the Products are ever used in lifting the boat; (b) the Products are damaged by improper installation, unreasonable or improper use, accident, modification, exposure to caustic or corrosive substance (other than salt water) or excessive or unanticipated wear or tear; or (c) the defective Products are returned without documentation establishing to EPCO’s reasonable satisfaction the date of the boat’s original manufacture, the identity of its original retail purchaser and the date and place of the original retail purchase. Defective Products and required information must be submitted to EPCO at 3736 Vanguard Drive, Fort Wayne, Indiana 46809.

 

EPCO is not liable for incidental or consequential damages, or other indirect expenses, occasioned by failure of its Products under this warranty. This limited warranty is given in lieu of and excludes all other warranties of any kind whatsoever, expressed or implied, and all implied warranties of merchantability and fitness for a particular purpose that exceeds the foregoing obligations are hereby disclaimed by EPCO and excluded from and by this limited warranty.
